1. About Women4Women BK

Women4Women BK is a New York–based nonprofit organization dedicated to empowering domestic violence survivors who want to reach economic independence.

14. Mandatory Arbitration and Dispute Resolution

A. Agreement to Arbitrate

By using this Site, you agree that any dispute, claim, or controversy arising out of or relating to:

  • These Terms and Conditions
  • Your use of the Site
  • Your interaction with Women4Women BK
  • Any donations made through the Site

shall be resolved exclusively through final and binding arbitration, rather than in court, except as otherwise provided below.

This agreement to arbitrate is governed by the Federal Arbitration Act and applicable federal law.

B. Scope of Arbitration

Arbitration shall apply to all claims, including but not limited to:

  • Contract claims
  • Tort claims
  • Statutory claims
  • Privacy-related claims
  • Claims relating to third-party services integrated into the Site

This provision survives termination of your relationship with Women4Women BK.

C. Arbitration Procedures

Arbitration shall be conducted by a neutral arbitrator in the State of New York under the rules of a nationally recognized arbitration organization.

  • The arbitration may be conducted remotely, by written submissions, or in person in New York County, New York.
  • Each party shall bear its own legal fees unless otherwise required by law.
  • The arbitrator shall have authority to award any remedies available under applicable law.

The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

D. Class Action Waiver

You agree that disputes will be resolved on an individual basis only.

You waive any right to:

  • Participate in a class action
  • Participate in a class arbitration
  • Act as a representative of others in any legal proceeding

The arbitrator may not consolidate claims of multiple parties.

E. Exceptions

Nothing in this section prevents either party from:

  • Seeking injunctive relief in a court of competent jurisdiction for intellectual property violations
  • Bringing an individual claim in small claims court where permitted by law

F. Opt-Out Right 

You may opt out of this arbitration agreement by sending written notice to:

within 30 days of first using the Site. Your notice must include your full name and a clear statement that you wish to opt out of arbitration.

If you do not opt out within this period, you will be bound by this arbitration provision.
