Know Your Rights!

If you are an undocumented woman living in NYC, we want to help you feel safe and empowered with the information you need to protect yourself and your children. If you ever encounter Immigrations & Customs Enforcement (ICE) agents, it is important that you know that you have rights:

  • You have the right to remain silent and you do not need to answer questions.
  • You have the right to refuse searches of your body, your home or your belongings.
  • You have the right to request to speak with an attorney.

Agents cannot enter a private space, which includes your home and certain parts of your workspace that your employer designates as private, without a judicial warrant. ICE may use lies or tricks to get into your home. You do not have to let them in.

If ICE is at your door:

  • DO NOT let them in. DO NOT open the door.
  • DO NOT say anything.
  • Ask to see identification and a warrant (ask them to slip it under the door).
  • If they do NOT have a judicial warrant, ask them to leave.

If ICE stops you outside:

  • Stay calm and do not run.
  • You do not need to answer questions or provide identification.
  • Do not lie or provide false identification.
  • You can ask “Am I free to go?”

There are many resources available to you. Women4Women can help link you to the resources you may need.

If you feel that your safety is at risk,

  • call 1.800.621.HOPE (4673).
  • If you are in immediate danger, call 911.
  • If you feel like you might harm yourself, call 988 for support.

Safe Horizon will listen to you, guide you and help you establish a safety plan.

You can also search for a county directory listed by the New York Coalition against Domestic Violence. Find an agency close to you.
